GCIS INTELLIGENCE BRIEFING: 1861 Civil War-era law may help Army operate under shutdown

GCIS INTELLIGENCE UPDATE: As the Army and the other military services face the prospect of a government shutdown by the end of the week, they are looking to the Civil War Era “Feed and Forage Act,” for potential authorities to continue operations, according to Army budget officials.

Under the law, the government is allowed to buy “clothing, subsistence, forage, fuel, quarters, transportation, or medical and hospital supplies,” for the troops before receiving the necessary appropriation from Congress.

The Act was first created during the Civil War for soldiers operating out West who had no idea whether a spending bill had been passed in Washington, but needed to resupply their ammunition, food and other necessary provisions, said John Cooney, who served as deputy general counsel in the Office of Management and Budget during the Reagan administration. GCIS INTELLIGENCE UPDATE: A new law passed by the Israeli parliament, the Knesset, allows courts for the first time in Israel’s history to revoke the Israeli citizenship of those convicted of espionage, treason, or aiding “enemy organizations”. The new law, which the Knesset enacted on Monday night by a vote of 37 to 11, amends the country’s revered Citizenship Law, which was first enacted in 1952. Along with citizenship rights, judges will be allowed to revoke the permanent residency permits of individuals found guilty of assisting organizations designated as terrorist by the Israeli government.  (read full report)

GCIS INTELLIGENCE UPDATE: A bill introduced Tuesday in the Alabama Senate would ban the use of Islamic law in Alabama courts.

Sharia LawThe bill’s sponsor said the measure was designed to protect future generations from erosion of the Constitution. One Birmingham area Muslim leader said the move was an effort to “demonize Islam and Muslims.”

But no one — not even Sen. Gerald Allen, who sponsored the bill — can point to examples of Muslims trying to have Islamic law recognized in Alabama courts.

“It’s not about what’s happening right now,” Allen, a Republican from Cottondale, said in a telephone interview.

“I’m thinking about 10 years down the road, 20, 30, 40. Time has an effect on these things, and I’m thinking about the future.”

Allen is the sole sponsor of SB 62, a bill that would ban Alabama courts from using Shariah law or international law in making legal decisions. (read full report)

GCIS INTELLIGENCE BRIEFING: In Tennessee, supporting Shariah law may soon be a felony

GCIS INTELLIGENCE UPDATE: A Republican lawmaker in Tennessee will continue advocating proposed legislation that would make it a felony in the state to knowingly support Shariah law despite criticism that the “shocking” bill is bigoted, he told FoxNews.com.

Islam's Sharia Law to be banned in TennesseeState Sen. Bill Ketron (R-Murfreesboro) said the bill, S.B. 1028, will be amended to allow the “peaceful practice” of Islam. He rejected calls to withdraw the legislation following a news conference on Tuesday held by several civil rights and interfaith groups denouncing the proposal. “[The bill] does not outlaw or in any way punish or target the peaceful practice of Islam,” Ketron told FoxNews.com on Wednesday. “It targets those terrorist Shariah organizations, those who are extremists. It has nothing to do with how they worship.”

Fox News reports that the bill, if passed, would allow the state’s attorney general to designate an entity as a Shariah organization if the organization knowingly adheres to Shariah; if the organization “engages in, or retains the capability and intent to engage in” an act of terrorism; or if the act of terrorism of the organization “threatens the security of public safety” of Tennessee residents. GCIS INTELLIGENCE BRIEFING: Marmara Raid Was in Accordance With International Law

GCIS INTELLIGENCE UPDATE:  The Turkel Commission, created to investigate the flotilla incident on May 31, has unanimously agreed that Israel’s military actions in capturing the Mavi Marmara were in accordance with international law.
 
The commission is officially known as the Public Commission to Examine the Maritime Incident of May 31, 2010. It is chaired by Jacob Turkel, a former Israeli Supreme Court Justice who is an expert in civil law.  The commission is comprised of four Israelis and 2 international observers, one of which is retired Canadian Forces Brigadier General Ken Watkin.  The commission has been tasked with releasing two reports regarding issues raised by the government over the flotilla incident.
 
The first report released on Sunday addressed the military action taken by Israel and the legality, under international law, of the naval blockade imposed by Israel on the Gaza Strip.
 
According to the concluding remarks of the committee members and observers, “The naval blockade imposed on the Gaza Strip - in view of the security circumstances and Israel’s efforts to comply with its humanitarian obligations - was legal pursuant to the rules of international law. The actions carried out by Israel on May 31, 2010, to enforce the naval blockage had the regrettable consequences of the loss of human life and physical injuries. Nonetheless, and despite the limited number of uses of forces for which we could not reach a conclusion, the actions taken were found to be legal pursuant to the rules of international law.”  (read full report)
